Annulment v. Divorce
An annulment is the process of terminating a marriage. However, unlike a divorce, after an annulment is finalized it will be as if the marriage never existed. This is much different than divorce. Although divorce is also the dissolution of marriage, the fact that the marriage existed will still be kept on file with the court. There are also several issues that must be settled before a divorce can be finalized, such as spousal support, child support, child custody, and division of property.
Grounds for an Annulment
Not all couples who apply for an annulment will be granted one. To be granted an annulment, a couple must meet at least one of the following circumstances:
- One of the spouses was underage when they got married
- One of the spouses was already married
- One of the spouses is/was physically incapacitated
- The marriage was forced
- The marriage was based on fraud
